10. Hearing speech (ESV)
We should interpret the meaning of the constitution based on the viewpoints of the individuals who attended the constitutional convention. Although this method is difficult as there were thirty one attendees at the convention, there are many different documents and methods that can be used to do this. The documents for this process include the supremacy clause, which claims the constitution to be the “supreme law of the land” and the Declaration of Independence that includes ideas of “natural rights”, and implementing them into a “new government”, which is what the constitution is based off of, that we can be helpful in interpretation. We should not interpret the constitution based on our own individual social values and needs. This clashes with the intentions of the framers. This is because the framers frowned upon the use of political parties. And many of today’s social values are based off of political party preferences. Instead of using social values, we can use the method of interpreting the unclear words in the constitution by using their easily accessible and reasonable dictionary definition.
11. YAHS (ESV)
Going along with Pierce’s previous statements, I believe that in the situation of a public speaker or influencer that calls for violent or criminal action, laws should take place in limiting their freedom of speech. The first amendment of the constitution protects citizens of the United States involved in peaceable protests, religious beliefs, the press or petitions of the government. Although the ninth amendment allows citizens to obtain rights that are not written in the constitution, I feel that encouraging illegal activity should not be included in these undetermined rights. I say this, because a 2019 study at Cornell University proved that in two individuals were convinced to perform an action which in my case, would be an illegal activity just by someone asking them to do so, without even thinking about it. And based on this information, criminal activity would be less likely if laws were in place to prevent the influence of criminal activity. I also believe that a person that calls for violent action, that encourages and influences activity that is against the law despite whether they are protesting or not should not be protected under the first amendment as the first amendment, as I have stated previously, only guarantees legal protection to “peaceable protests”. The Oxford English Dictionary defines peaceable as an adjective that describes any action taken to avoid violent conflict and also because the fourth article of the constitution blatantly protects every citizen of the United States from domestic violence.
